End User License Agreement (EULA)

This End User License Agreement ("Agreement") is between you and FinAssist (EDIT LATER) and governs use of this app made available through the Apple App Store. By installing the FinAssist App, you agree to be bound by this Agreement and understand that there is no master relationship between you and Apple.

1. Scope of License

FinAssist grants you a limited, non-exclusive, non-transferrable, revocable license to use the App for your personal, non-commercial purposes. You may only use the App on Apple devices that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

2. Termination

• Right to Terminate: We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates this Agreement or is harmful to other users of the App, us, or third parties, or for any other reason.
• Automatic Termination: Your rights under this Agreement will terminate automatically without notice from us if you fail to comply with any term(s) of this Agreement. Upon termination of the license, you shall cease all use of the App, and destroy all copies, full or partial, of the App.

3. Maintenance and Support

FinAssist (EDIT LATER) is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

4. Warranty

FinAssist (EDIT LATER) disclaims all warranties about the App to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, FinAssist (EDIT LATER), not Apple, shall be solely responsible for such warranty.

5. Product Claims

FinAssist (EDIT LATER), not Apple, is responsible for addressing any claims by you or any third party relating to the App or your use of it, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

6. Intellectual Property Rights

In the event of any third party claim that the App or your possession and use of that App infringes that third party’s intellectual property rights, FinAssist (EDIT LATER), not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

7. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third Party Terms of Agreement

You must comply with applicable third party terms of agreement when using the App (e.g., your wireless data service agreement).

10. Third Party Beneficiary

Apple, and Apple’s subsidiaries, are third party beneficiaries of this EULA, and upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third party beneficiary thereof.
