Terms of Service

1. Acceptance of Terms

By creating an account or strictly using the FinAssist (EDIT LATER) application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Who May Use the Service

• Age Requirement: You must be at least 13 years old to use the Service.
• Mobile App Requirement: Account creation, sign-in, transaction entry, and subscription payments are performed through the Mobile App (iOS/Android). The public website does not provide a browser-based application experience.

3. Account Security

You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

4. Subscription and Payments

A. Freemium Model

• Basic Version: Includes manual expense tracking and limited reporting.
• Premium Version: Includes AI Chatbot, Automatic Receipt Recognition (OCR), and advanced insights.

B. Free Trial & Billing

• Trial: New users may be eligible for a 14-day free trial. If not cancelled, it converts to a paid subscription.
• Merchant of Record: All payments are processed and managed by Apple (App Store) or Google (Play Store). FinAssist (EDIT LATER) does not directly store credit card information or process payments.
• Cancellation: You must cancel subscriptions via your Apple ID or Google Play settings. Uninstalling the app does not cancel your subscription.

5. User Content & AI Usage

• Ownership: You retain ownership of any data or images you submit.
• License: You grant us a license to process this content solely to provide the Service (e.g., analyzing a receipt).
• AI Acknowledgment: You acknowledge that the Service uses Artificial Intelligence. AI responses may occasionally be inaccurate. You should not rely on the AI for professional financial or legal advice.

6. Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose.
• Attempt to reverse engineer the Service.
• Use the Service to store sensitive data (e.g., health data, unredacted government IDs) not relevant to expense tracking.

7. Disclaimer of Warranties ("AS IS")

A. General Disclaimer: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. FinAssist (EDIT LATER) makes no representations or warranties of any kind, express or implied, regarding the operation of the Service or the information, content, or materials included therein.

• We do not guarantee that the Service will be uninterrupted, secure, or free from errors or viruses.
• We are not responsible for data usage charges incurred while using the App over mobile networks.

B. Backup and Data Loss: You are solely responsible for maintaining backups of your data. We are not responsible for any loss of data, corruption, or failure to store any User Content, whether caused by software error, server failure, or third-party service interruption.

C. No Professional Advice: FinAssist (EDIT LATER) is not a bank, broker, insurer, or licensed financial advisor. The Service is provided for informational, educational, and expense tracking purposes only. We do not provide financial, legal, tax, or investment advice. You should consult with a qualified professional before making any financial decisions.

8. Limitation of Liability (Shield Clause)

To the maximum extent permitted by applicable law, in no event shall FinAssist (EDIT LATER), nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, data, use, goodwill, or other intangible losses;
• Damages resulting from your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service.

Limitation Cap: In no event shall our total liability to you for all damages exceed the amount you paid us, if any, for accessing the Service during the 12 months immediately preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless FinAssist (EDIT LATER) and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

10. Governing Law and Dispute Resolution

• A. Jurisdiction: These Terms shall be governed and construed in accordance with the laws of The Hashemite Kingdom of Jordan, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Amman, Jordan.
• B. Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.
• C. Consumer Protections: Nothing in these Terms affects your statutory rights as a consumer or deprives you of consumer protections under the mandatory laws of your country of residence that cannot be waived by contract.

11. Severability and Waiver

• Severability: If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via the App or email. Continued use of the Service after changes constitutes acceptance of the new Terms.
